There seems to be some red flags in the campaign and I want to share my concerns with the creator and all the other backers, esp those who have backed at very high levels. I hope the creator will be able to address these and post an update. Here are the red flags:
1) The cover picture of the project is actually a shirt by another brand: http://www.sharpeonline.com/newsandsuch/58202-electric-art 2) The pictures in the campaign are all from other brands with a photoshopped logo of Sivil. For example, the main picture explaining the shirt is actually an Under Armor UA Tech shirt: http://d3d71ba2asa5oz.cloudfront.net/62000918/images/1229078_459_front.jpg 3) The shirt in the video is not the same shirt as any of the pictures shown, so naturally that must be a regular sports shirt with a Sivil logo attached to it. Am I wrong?
4) Throughout the majority of the campaign, the video featured "coolcore" technology and used a lot of this video clip by "coolcore": https://www.youtube.com/watch…
The backers backed your project with the information and technology you portrayed to be using. Now as the campaign is nearing its end, the video has been changed without any explanation to the backers. If things have changed, please communicate that.
5) You have stopped responding the backers' comments since launching the polo shirts and you're selling the polo shirts on Kickstarter for a higher price than what you want it to retail for. How does that make any sense?
6) The five year deal that was promised to early backers is vague. It would be good for you to clarify exactly how it works.
I hope you're actually making a product instead of portraying other brands' products to be your own. That would actually be worse than Radiate.

Guys, sorry for the delay here, I know i have a lot to get to.
First to address the image issue. This is a total blindside to me as well and I'm very embarassed. I had our samples made using the fit of under armour shirts to be able to better describe the fit of each shirt. I had those shirts sent to a professional photographer in Philadelphia ( i won't name out of courtesy ) to have several photos taken with the shirts. It's clear now that they just sent me photoshopped images of branded shirts from smaller online retailers. That's a total misrepresentation my end and a total miss. The shirts you see in the video are all ours as you can see from the logo. Additionally, what i can do is have some simple photos of the shirts taken when I get home to show you, they just won't be professional. I know trust is a big thing here, and I really apologize for this. I can assure you that I had no intention of misleading you guys. I totally understand your concern. Give me a few hours and I'll have some other photos put up. Just remember, the shirts are modeled after the fit of the Under Armour tees.
Regarding CoolCore. I reached a point with them where they would not develop certain fabric weights for me to adhere to what the demand was. Additionally, I am now working with a company called Garmatex. Check them out at Garmatex.com. Their fabric technology is absolutely unreal and I think you'll all be much more impressed with what the technology that will be available in the shirts.
There is no fabric that is made in the USA, 99% of fabric is made in mills in Asia. However, all of our shirts will be constructed in the United States. This means everything from cutting, sewing, trimming, and printing will be done here in the United States at factories is Los Angeles. Virginia, and North Carolina.
I understand there's some concern here, but I assure you that I'm going to deliver you guys an amazing product that you'll be extremely impressed with. 2) You said you would post pictures of the actual shirt yesterday, yet you have not showed us any pictures and each and every single picture on your campaign page are still shirts from other brands with your logo photoshopped.
3) You claim "The shirts you see in the video are all ours as you can see from the logo". Having a logo on a shirt does NOT make it yours. Anybody can buy a sports short and put a logo on it. Even the stitching and cut on the shirts in your video does not even have the "activeseam" stitching you claim to be using.
My only concern really is that you have not created an actual product yet. You're only showcasing companies that make fabric. Please show us proof that you've actually created a prototype shirt of what you're going to be making with the backers' money.

In Kickstarter's rules and terms of service they require backers to be shown an actual prototype. Wasn't it discovered that the shirts pictured were actually Under Armor shirts with the Sivil logo stitched or photoshopped on them?
Clearly Will and Vince broke the rules and Kickstarter will not enforce their own terms. Since Will and Vince fail to respond to anyone, Kickstarter should be responsible for refunding backers.
This is not an issue of they tried and failed. This was a scam from beginning to end.
This seems to be one of the few ways I've found that may have any kind of result, less hiring an actual attorney to go after these guys. If any of y'all find another helpful resource, please let us know.
I've just been thinking, given that we have all entered our home and email addresses in the last survey isn't there some sort of legality on this as they have been falsely attained.

Unfortunately for me, I used a debit card through Apple Pay to make my pledge. I would have been better off using a credit card. At least then I could have made a dispute.
I'm glad some are receiving refunds through their CC companies. Even though they shouldn't be responsible for what is so clearly a scam. Perhaps if everyone who used a CC files a dispute, the CC companies themselves will put pressure on Will and Vince.
I've already kissed my money goodbye, now I'm just looking for some justice.

If 3,759 people marched in a city it would make news and get politicians involved but as were stuck in a comments section no one else is aware of this problem and were stuck in a constant loop.

This article is about the similarly failed project Radiate, and how the Pennsylvania Attorney General filed suit against the company. After reading the article, I filed a complaint with my Texas Attorney General. Kickstarter is very little help at this point, so I guess it's just up to us backers to actually try and remediate this shitty situation we've been put in. I know some backers aren't in the US, but for those of you that are, I would suggest filing a complaint with your respective AG. Although it's a slim chance, maybe, just maybe, if enough of us report these guys something positive will come about.
Unfortunately, you're not going to get a refund directly from Kickstarter. They clearly state in Terms of Use its between the Creator and backers. I've tried to contact them and they basically don't care. Only recourse is backers sue them. The comment from Vince wanting the little kid to get hit by a ball is disturbing, and either shows he's going for e-tough guy/shock post image, or he's a horrible person.

I just went and filed a ticket with Kickstarter.
If you go to the bottom of the page and click "Support" located under the "Help" column, it will take you to another screen where you can locate what type of help you need.
Select that you need help on one of your pledges. It will ask you what kind of help and select help on your reward. There is a button called "Creator Accountability" and then it will allow you to open a "Support Ticket".
Go in there and explain that you need a refund for this project. Put the project name in there either in the subject or the body of the message.

I can't believe how easy Kickstarter allows "creators" to get off the hook once the funding has ended. It makes me think that just about anyone can create a project to raise funds and just start ignoring their backers, while periodically giving BS excuses.
I have accepted the fact my money is gone. I'm now convinced this waa a scam run by insecure little boys. We can only feel a little comfort in knowing that karma will repay them 100 fold. To be honest, I feel bad for Will and Vince Simon. They think they are entrepreneurs, but they are really just con men who will eventually con the wrong people.
I've claimed my money back through my credit card company. It's a temporary refund as they are still investigating the case, but it's better than nothing. Here is a good tip for all: use a credit card with a good customer service to make KS payments, so you can dispute the charge if the project goes sour.
These kind of scam projects are not very common, but it sure kills our spirit. I am not backing out of KS, but I will be a lot more skepital of projects in the future.
Damn, I checked back in again. Why do I do this? I backed a few Kickstarter in a short period of time, but stopped after this mess. Kickstarter needs to change it's policy as it is costing them money in the long run.
I got barred by KS for a week after posting something abusive here. I don't really see what I posted is abusive at all. But who cares, I am off KS anyway.
So again, kudos to the best workout shirt never made for taking away my money. Thanks guys.

I can't believe how easy Kickstarter allows "creators" to get off the hook once the funding has ended. It makes me think that just about anyone can create a project to raise funds and just start ignoring their backers, while periodically giving BS excuses.

I have accepted the fact my money is gone. I'm now convinced this waa a scam run by insecure little boys. We can only feel a little comfort in knowing that karma will repay them 100 fold. To be honest, I feel bad for Will and Vince Simon. They think they are entrepreneurs, but they are really just con men who will eventually con the wrong people.

I've claimed my money back through my credit card company. It's a temporary refund as they are still investigating the case, but it's better than nothing. Here is a good tip for all: use a credit card with a good customer service to make KS payments, so you can dispute the charge if the project goes sour.
These kind of scam projects are not very common, but it sure kills our spirit. I am not backing out of KS, but I will be a lot more skepital of projects in the future.

Damn, I checked back in again. Why do I do this? I backed a few Kickstarter in a short period of time, but stopped after this mess. Kickstarter needs to change it's policy as it is costing them money in the long run.

I got barred by KS for a week after posting something abusive here. I don't really see what I posted is abusive at all. But who cares, I am off KS anyway.
So again, kudos to the best workout shirt never made for taking away my money. Thanks guys.
