@Eli Allen, Kickstarter is like any other marketplace. Some times you get what you expect, some times you don't and some times you get shafted. Chasing $25 (out of $19k) is really not worth your time or any lawyers time. Just accept you got mugged and move on.
@Blindman2k: Yes, and it's closer to a $19,000 fraud. Maybe you are okay with people killing crowdfunding by turning it into a market for scam artists, but if Kickstarter isn't going to do anything then it is up to the people that have lost money to act.
I'm thinking that submitting a class action one of has the larger websites like the one below would yield some results. It has enough visibility and ease of submitting that it would be easy enough. However, I believe this DB probably has no money left. People like this simply won't have anything of any value in their life. The money is gone, and I'm sure the family probably isn't too far behind.

@ Mike. I get where you are coming from and know that government intrusion can be a real pain, but there is a real sense of lawlessness afoot in this emerging gray arena of commerce/investment. I do agree that poorly constructed legislation can become a burden, but well thought out regulation can have the effect of forcing KS, Indegogo and others to do more effective self-policing and having a more active role in shutting down bad actors within their respective arenas. If KS and other funding facilitators are given a greater amount of liability, then they will be incentivized to be much less laisser-faire I don't give a rats a** how much funders are shafted attitude - than they are acting now. I think it's worth the risk of regulation.

@Kenneth Jaffe, the last thing I want to see is Congress getting involved in regulating crowdfunding. I personally am willing to trade the risk of a few bad apples for the freedom to fund truly worthwhile projects without the burden of excessive government regulation. If the government does get involved, creators and backers alike will be weighed down with burdensome regulatory compliance, all the lawyers will get rich, and many projects will not even be started because people can't afford to hire a lawyer of their own.
I've contacted my US Congressperson to see if there is any legislation in the works to oversee this "Wild West" crowd sourcing industry. I'll let y'all know if I hear anything back.

Just a damned shame that KS is SO hands off on the criminal activity that is happening under their aegis. I'm planning to contact my new congressman to see if there are any thoughts about federal legislation afoot to reign in the Wild West attitude on funding sites like KS & Indegogo.
KBI was helpful. This crime is outside of their remit, however they gave me the most appropriate avenues to follow at both the local and federal levels.

Had this campaign been one where the creator maintained contact and updated the backers regularly, I would be inclined to forgive the debt - we are after all investors, not shoppers. Unfortunately as soon as the funds were received, the communication ceased. That is blatantly a planned fraud.

I find it difficult to be respectful and considerate when people commit theft.
I worked for the money that I believed to be investing into a start-up and in turn would recieve a pre-agreed to reward. No my reward is getting to fit with Amazon over getting my money back. I opened a ticket with KS, so then I get to see what my reward was for asking for costumer service when I company backs any obvious fraud.
@Prairie Patriot - sorry to hear he's fallen on hard times, but fraud is fraud. There is no evidence that he ever had any intent to fulfill his obligations - I'd welcome any evidence to the contrary. I don't know if local law enforcement would be interested in pursuing it. The amount involved is a level 9 felony in Kansas, a conviction could *really* make a mess of his life. Otherwise, I guess we could file in small claims court, but that would probably cost us more than we'd ever recover. The more punitive of us might enjoy knowing destroying his credit (but I'd bet it's not good anyway) and setting a collection agency on him, but ultimately if he can't pay, he can't pay.
Another 100.00 down the drain... I have been a Kickstarter supporter for a long time. I am involved in some rather costly projects. (I do have the first Oculus Rift and I bought the 2nd version directly) I have a decent amount of money in projects here. This one is not the smallest but I really liked the idea. Slowly as I look through all the projects that are not being finished or turn out to be scams to begin with I am thinking about being finished with Kickstarter. They should have a way to help us get something I think they should make the project creators leave the money in a PayPal like account, have them pay all the project bills with a credit card from the PayPal like account. Then they can track and freeze the account if they notice something strange. I know that's a lot of work. However how much money can we collectively throw away ? if A project does not deliver kickstarter should at least give back its cut of the money collected.

I don't know what happened exactly, but I would not hold my breath on getting our money back. Judging from his FB postings he's in a bad way on a personal level. That's all I really know. I kept holding off on commenting hoping it was all a big misunderstanding, but I think it's safe to bet this was either a ruse from the beginning or a project gone horribly wrong.
@James dellow no I have not. I am very annoyed. I tried posting on his Facebook wall and it was deleted within minutes. Because I supported Shawn, now I am getting a backlash by people looking at my own kickstarter. I am struggling to get any support. If I would have known this, I would have never invested into the batteries. I feel bad for everyone who also invested into the batteries. I tried getting a first crack at a new technology and get screwed....
@Dennis- have you had any further communication with Shawn? If so, is he aware of how this looks to even the most ardent KS fan and, if not, could you contact him on our behalf to let him know? It seems almost incredible that someone from the Western world, who is heavily invested in technology, would be unable to access the internet at any point over 4 months. I am also somewhat surprised that Shawn was able to access Facebook as of Dec 5th without any internet access.
KS have consistently demonstrated they couldn't care less about the boundless fraud perpetrated against backers throughout the site, and have no remorse in actively protecting the charlatans behind projects like this one! Despicable. Removing comments with very public information is beyond ridiculous.
Anyone tried contacting his friends on his facebook? They might probably know what happen to him. He obviously is still around as his recent update on his Facebook was 6th December
