      @pk How much did you pledge? I am guessing he is not going to give refunds for higher-value pledges. $10 is a small price to pay for censorship. Hopefully Kickstarter doesn't revoke our right to post here.

      I would suggest that backers who desire a refund create a list where names get added by each individual.

      @Owen D'Aprile: If Price refuses to refund you, follow the steps outlined below on demanding a refund via the United States Federal Trade Commission (FTC). Essentially state who you are and a brief summary of your complaint, link to the Summary of Allegations Against Christopher Price ( http://www.consoleosripoff.com/showthread.php… ) and especially mention that as of today only a select few backers, not all, are being refunded. Use the rest of the guide to fill in the blanks as you go through the steps.

      Most recently, the FTC has been more and more legally active and has successfully forced guilty Kickstarter start-ups into refunding their victim backers. Therefore, if enough of us backers make "noise" through these channels, it is reasonable to conclude the FTC will take legal action and ensure financial compensation for all.

Unlike Price, I am currently riding on a couple hours of sleep for a legitimate reason for burning the midnight oil.       I've heard your issuing refunds and I'd like one as well. I backed this with hopes of dual-booting Android on my Surface but it never came to fruition and I sold my Surface over the summer. If you can do it, that'd be great.

      I already emailed AndroidPolice and a few other news outlets that have been following this story.
      Perhaps one of you that's more reddit savy could get it back on the front page of the /android subreddit...?

      Christopher Price refunded us vocal backers and yet he cannot ship remaining perks to those who are more heavily invested in the project. This is obviously an attempt to quiet us through bribbery:

      He also said on Reddit about a month ago:

      "Wish that were true, but responding to matters like this takes real time, of real people...there's no way we can just pen that reply, and hit the post button. We have to circulate it between partners, legal, etc."

      So between "angel investors" (whose existence there is no evidence of, naturally) and less than $50,000, he has managed to pay an entire "team" to develop Console OS going on two years now, he also bought gear, paid for Intel licences, pays PR people, and at least up to a month ago, had legal consultation ("real people" who I'm sure then must've charged him for their "real time"). Yet, after it all, he has money to ship perks to thousands of Kickstarter backers.

      Will he refund you is the question?

      Here is a finalized summary of the allegations we have against Christopher Price. Moderators and administrators, please feel free to build upon this list. Insert links and photos in the exhibit sections. Please try to keep this as precise and succinct as possible. Please distribute this information through all channels, including news sites, forums and social media. This may also prove to be very helpful for our legal counsel as we continue to finalize our class action against MMV/Console Inc.

      1. No one else except Christopher Price works for MMV/Console Inc. Since day one of this project, he has refused to answer the simple question of the number of employees in his company. However, he claimed earlier in the Kickstarter comments section to have "engineers", which is plural meaning at least two other employees besides himself. However, he now refrains from referring to his departments at all by quantifiable nouns, instead resorting to using terms such as "engineering" to describe areas of his company. When asked on multiple occasions for the number of employees in his company, he pretended to have been asked for names, not numbers.

      2. He falsely claimed to have already delivered Console OS Pro. He has said in the Kickstarter comments section that he already delivered "Console OS Pro" to backers. Currently, Console OS still lacks Pro features. The Pro version, by definition, would have Pro features.

      3. He still has not shipped any of the physical rewards to backers.

      4. He tested thousands of paid Play Store apps without prior backer consent, either using thousands of dollars of Kickstarter funds to purchase them or engaging in pirating to obtain them. He claimed online that he had tested thousands of paid Play Store apps on Console OS. This would mean he had either spent thousands of dollars to purchase them or he had obtained them illegitimately by pirating them.

      5. He falsely claimed to have already built a prototype with over 100 features already built-in before the project campaign. He has been unwilling and unable to produce the original prototype that he already "built" prior to the project. Likewise, he has been unwilling and unable to provide verifiable visual evidence, either through prerecorded video or live screencast, which showed said prototype had "over new 100 features already built-in."

      6. He fraudulently obtained backer funds by purposely withholding information about Android-IA for Core's suspension until the refund window had past. He withheld the information that Android-IA for Core's development had been suspended, of which he was informed three days after the campaign had ended. He did not let backers know Android-IA for Core was crucial for Console OS's on-going development. He even made it appear in campaign materials that it was a direct competitor, not the basis for Console OS's code. Somehow, the rest of the industry understood Android-IA for Core's suspension to be indefinite but not Price. He did not inform backers of its suspension until backer funds could no longer be refunded, almost six months later. Per Kickstarter policy, all project creators can fully refund their backers through Amazon Payments up to 60 days after a campaign has ended.

      Exhibit A: "@Dave - We're still determined to make that happen, despite pullback from partners. Had Intel called us up during our Kickstarter campaign and said 'hey, heads up, yes we can confirm we're suspending Android development for Core processors' - then we would have posted that.
      We didn't get confirmation of that until three days (72 hours) after our Kickstarter campaign ended... it was a punch in the gut, frankly we're even surprised we got this far in the wake of that."

      I also received refund money in the full amount I originally contributed. It is obviously an attempt to silence us backers who are wise to Price. He is insinuating that we did wrong, or were the principle source of Community Guideline warnings. That is not his real reason. We had been posting information which exposed the fraud in the project. Feel free to demand a refund as well since you owe it to yourself because it is inherently unfair that I receive a full refund while you other backers do not. Before I am permanently removed from this project, I am posting important allegations and evidence for everyone else's future reference.

      @mmv - Wait, wait, you said all the money has been used up and cannot be refunded and because of that there had been many comments flagged and removed by Kickstarter. But how come now you refund?(100$ is a very large amount in India such that you can offer good food for atleast 50 people)

      But Yes, I can understand it, you are trying to shut down the mouth of some backers like ACH, Ian R, Sean, Charles, etc who raised on the occasion, by giving them the refund amount. So, and you also accept that things did not go as planned(ie,The failure of the project).

      @MMV. thanks for the refund. You are apparently trying to silence us. After 18 months, there is still no working version of CONSOLE OS PRO. No 100plus built in features. No rewards sent out. No names of 100$ backer on your thanks page. And no remain in votes for people who pledged for them. Please note you have failed in every facet of this project, even with your self imposed deadlines. By KS terms or service, veryone here is still entitled to a refund. EVERYONE IS ENTITLED TO A REFUND.

      2) Pretty sure all of us who did get a refund only got it because they're about to remove our ability to comment here in the future lol that's called "hush-money"

      I got a refund too, and feel the need to respond to the note goes with the refund message:
      1) as far as I know I do not have any message removed by Kickstarter, obviously @MMV try to portrait himself as the victim but I do not think it Is the case here.
      2) contrary from the statement in the note, I feel myself to be fortunate getting the refund and not be involved in this show put up by Mr. Price any more. Shareholders, or in this case backers, do monitor. I am glad the mechanism works and I sincerely hope more backers would realize and act.

      We are only refunding a very small number of backers in cooperation with Kickstarter. These few backers account for half our comment wall. We will issue a full comment once Kickstarter has confirmed to us that they have completed their part of the process.

      To be clear, only about a dozen people are being refunded, the majority had multiple or numerous Community Guideline warnings from Kickstarter. That's all for now.

      After re-reading the e-mail from PayPal I'd just like to point out that Price seems to be trying to frame this as a punishment, and then tacitly admitting that he just wants to silence dissenting backers.

      For the record, I've never had a single comment removed by Kickstarter.

Unfortunately, you are one of those backers. This decision was made after hours of consultation with Kickstarter, and it will help us ensure Kickstarter can enforce Community Guidelines properly in the future on our comment wall. If you have issues receiving this payment via PayPal, please reply to this email with a mailing address, and we will mail you a refund check. Thanks."

      Even the refund message is accusatory. Love it!

      @Lucas - Thanks for your support, but you won't have to wait a year. We have a couple more waves worth of code to put up on GitHub, but we really hope to get a build in your hands this weekend that we're excited about. Just get a 16GB-or-larger flash drive ready this weekend!

      Meanwhile, we're already working on Marshmallow. As we mentioned, we've been building that in parallel - one thing we're working hard on (when time permits) is getting rid of the per-device build targets, by slipstreaming those into the init.rc files. Android-x86 wasn't set up to do that, but we are working on more advanced per-device controls.

      i stand corrected. i just browsed the console inc forums (namely the devices section) and there are a few people there who seem to have installed dr1 on their device. they do report multiple problems (like sound and wifi not working or glitching) and i know its no consolation to the rest of us still waiting but it does answer my question whether anyone has actually tried installing. it seems a number of them are not backers so maybe that's why they aren't posting here. one thing i would like to recommend to the creator - there is a lot of spam on the forum, maybe it should be cleaned up. looks like some of your supporters are there so might want to keep them happy. just a suggestion...

      Console OS KitKat supported most target devices, as promised. Unfortunately Intel failed to deliver promised support for UEFI32 devices in Android-IA for PC. They announced and touted this at IDF 2014 (after our Kickstarter ended), but never shipped it.

      By switching to and forking the Android-x86 kernel, we have agreed with Intel to take the best parts of Android-IA, and integrate them into Console OS with Android throughout this year.

      We are not going to rehash this topic further as our efforts are best spent on shipping Console OS Lollipop, which we still hope to do late this week.

      @ssiu - yup so it sounds like you are in the same boat as me. and according the creator, you did receive console os kitkat, it just doesn't work on your device.

      If I remember correctly, Console OS KitKat does not support any "UEFI32" devices including my ASUS T100 Baytrail tablet.

      @fellow backers - so i received console os that doesn't work on my device. have any of you received and successfully installed it on yours, since apparently console os kitkat was shipped with support for most target devices (just not mine?) just curious to know from backers which ones were successful. thanks.

      Umm yes they have... The Acer Predator 8 runs a Intel Atom x7 and is available on Amazon right now.

      Yeah Dennis, it wasn't functional on my "launch" device either (Vaio Tap 11 i5) and if it weren't for the tablet's "rescue" feature it would have been effectively bricked. Unsurprisingly the support forums were completely unhelpful.

      If I knew then what I knew now I wouldn't have even bothered installing it (well, I wouldn't have backed, but that's a foregone conclusion at this point).

      @Harry - Support for Surface 3 is much more likely in the Marshmallow cycle.

      Understand that Intel has not even begun to ship Android-powered Atom x5 or x7 ("Cherry Trail") devices in the USA yet.

      Asking us to leap ahead of Intel in terms of SoC/CPU support is very difficult, if not impossible much of the time.

      Unfortunately, as the marketplace has shown, it takes time to support new Android SoC's that are outside of Google's Nexus family. More time than we all would like.

      We encourage and support Google switching to an open-design model (similar to Chrome OS) that would reduce this turnaround time.

      As one of the 58 backers who pledged $100 or more, I would like to know what I get? So far I have received a big pile of nothing. I do not believe I am mentioned anywhere in the Console OS credit screen. Console will not work on my Venue 8 Pro (see conversation below). My V8P is dying anyway as the microUSB port needs soldering and it is totally not worth the time and money to do that.) My new tablet is a Surface 3 with LTE so I would like to know if you have any updates on running Console on Surface 3 with LTE?
