Have a question?
So... this was just a scam to fund his ebay shop?
This guy is a legit scumbag. I hope one of those awful drivers he made fun of in his cards runs him over.
He's caught on to us! I ordered through eBay and he canceled my order within 24 hours before shipping.
I did exact what Kevin Maxam suggested below via eBay and Josh personally accepted the refund within hours.
It's been over a year and I still haven't received my pack.
I did what Kevin Maxam suggested, and received a refund within a couple of hours of my request.
Thanks Kevin for the advice! I felt kind of frustrated that I didn't get my cards. I'll try your advice.
Just wanted to report that I did as a few others here have done and ordered the cards from his ebay site: http://www.ebay.com/itm/201555396269 ... then after I received that shipment (which showed up pretty quick, about 3 days) I reported on the order on ebay that I did not receive it, and requested a refund.
Here's what I wrote on the refund request on ebay:
"I was a backer of this project on Kickstarter, paid $20 there, but never received the cards. So I ordered them here on eBay, then I received the cards. So that covers my Kickstarter order that I had placed way back in early 2015. So please refund this order since I no longer need this shipment. To recap, I paid $20 on Kickstarter in March 2015, and $20 here on eBay last week and received only ONE deck of cards. So, again, please refund my $20 here. Thanks!"
Within a few hours I got an email back from ebay saying Josh had refunded the $20.
Hey if anyone is still planning on sending him letters I think he is using a few different addresses. I looked up that Palomar Lane address and I don't think it's real, nothing matching comes up in google maps.I ordered a deck from his flying kites ebay account and received it a couple days ago, so I figured I would try the ebay refund thing. Well I accidentally requested to return the item, which I plan on canceling. But the good news is I think I have a real address for him if you want to send letters or use it in a police report. The address he sent me for the return is 2739 LONGFORD DRIVE SAN JOSE CA 95132, and it's a legit address. Also the the return address on the actual package was something else, I'll go find it and post that one too. Hopefully this helps out.
I still haven't gotten mine. No updates. where is everything?
Is there any more updates? Also where can I update my shipping information
I still haven't gotten mine.
Well, shit, this was a bust.
I also filed a claim. Josh had been on Kickstarted recently and is ignoring his responsibilities. I hope the FTC gets in touch with him so he can resolve the issue since he will not talk to us.
It looks like cowardice and is a shame. We supported his idea and he doesn't have he strength to address us and instead lies to say the cards were shipping.
Update for Santa Clara County PD (don't file police reports with them):
Your crime occurred in the jurisdiction of the San Jose Police Department. They would be the agency that would investigate any crime. Please contact them at 201 West Mission Street, San Jose, CA 95110 (408) 277-8900.
I have filed an online police report for fraud against Josh with Santa Clara County at https://secure.coplogic.com/dors/en/filing/selectincidenttype
My police report is T16000759 if you want to mention it when you file your details.
Josh - are you going to provide refunds to all your backers that you have not shipped to since it's getting pretty clear that you are never going to ship?
Thanks, Allan. Maybe CAH will have more influence with ebay than we have.
Well, at least the dollars invested are small compared to this @kickstarter screw up. http://www.theverge.com/2016/4/13/11424924/coolest-cooler-kickstarter-disaster-delays
I have been in contact with Cards Against Humanity directly, and while they are kind of powerless to do much about this (and rightfully so) they do continue to try to get him shut down on Ebay. So thanks to them at least for being the only responsible company in this whole thing.
It seems he moved the listing to another eBay account.
Sadly, I think contacting the investigative units of the local news stations is our only recourse. Kickstarter has no interest in the community it says is so proud of. I will never again back a project on this site. Fuck fuck fuck Kickstarter (I write this to trigger their bots and get some attention to this Comments section. My apologies in advance if I offended anyone.)
Yeah, sadly, Kickstarter as a company has been woefully inept at helping in this situation. I'll still back projects through the platform, but only if I know the project creator or they have had numerous successful projects. One suggestion...Maybe try something like one of the consumer affairs reporters for one of the local TV stations. They LOVE this kind of story, and Kickstarter will HATE it, so you might get some traction that way.
How is kickstarter not getting involved with this? This is clearly some messed up stuff going on here... Kickstarter? Hello?
file a complaint with the ftc- https://www.ftc.gov/
I still haven't received this product. Is there an update since the last one in October? Will it actually ever get shipped?
I am tired of being respectful and considerate (per the suggestion below). Kickstarter, you are a disappointment. I thought you'd care about your community, but you clearly have no interest in supporting your backers. I've politely emailed you on multiple occasions, and I don't even get the courtesy of a response now. Fuck off, Kickstarter! (sorry folks, but I'm hoping the foul language will catch the attention of their bots).
Hey, I did the ebay approach as well, and got refunded without any issues for filing a "missing parts" and adding a payment proof of the kickstarter to it. But that was early February.
If you are planing on doing the same, don't announce it in the comments. Even though Josh refuses to ship the product out and doesn't respond to the comments or messages, he probably still reads the comments. Which means he will cancel your order when you announce going the ebay route. I'm sorry to hear it has gotten so complicated with him.
A civil suit would only get our $15 back, which is trivial. The issue here is fraud and deceit, which is a criminal action. It would help if Kickstarter themselves got involved, but they refuse to comment. I am baffled by their silence.
Do you think they'd notice if we weren't "respectful and considerate"? Would that get their attention?
Please pardon my french, but I'm going to try it. Let's see what happens if I say "this is fucked up."
Wow, he got super high rating on eBay, and people love this expansion. He even used Kickstarter badge on his product picture.
But we don't even see one single card.
This is crazy, what should we do now? Sue him together?
Allan, I'm sure there are a lot of porn, home shopping, and political sites that would be very appreciative to have Josh's email address...
Allan Hosmer, allow me:
5625 Palomar Lane
San Jose, CA 95127
Have at it!
For those of you who took a shot at the eBay route and got cancelled you can still leave feedback for that "transaction" on eBay. I just did that (even though he cancelled my order) and 1 star'd him and a blurb about this being a scam. I figure we do enough of this and you can tank his rep on eBay as well. As far as I know, most people won't buy from someone with a low rating on eBay. Worth a shot.
Thanks Allan for the extra work.
This Josh guy totally stole out money.
We paid for a real in hand product made and shipped to us.
Instead we get nothing n return.
Thanks, Allan! That's a big help.
This is the PayPal email address he uses if that does anything - firstname.lastname@example.org
Hey guys...sorry he continues to make this so difficult. If it helps any I have sent an email to the Cards Against Humanity guys letting them know that Josh is using their name to commit fraud and pointed them to the comments here and the ebay link. I was never given his address so I can't help you there.
On January 25, Eric Nadler posted this comment, which is where I got the address.
"Eric Nadler on January 25
For anyone looking to contact Josh Barrientes directly, you can do so at
3625 Palomar Lane
San Jose, CA 95127
I encourage EVERYONE who has yet to receive the fulfillment of their Kickstarter backing to send him a letter.
I can definitively confirm that he is selling the expansion packs on ebay for $19.99. I ordered one and received it within 4 days. I am counting it as my fulfillment for the Kickstarter campaign, and claiming that he has yet to fulfill the ebay purchase.
Now that we have an address for him, maybe we can hold him to his commitments."
Anyone else who received their cards through eBay, what was the address he used?
Can anyone confirm that his address is really -
3625 Palomar Lane
San Jose, CA 95127
I'd like to report a complaint to the Santa Clara County District Attorney Office for Consumer Affairs. There is enough evidence here (from comments) and a supporting kickstarter lawsuit case (AsylumComplaint 2014 05 01 - State of Washington) to justify refunds.
It doesn't matter because he's canceling orders.
Sorry Olivia - I didn't realize you were waiting for a response. It sounds like in the mean time there has been mixed results with the way I got my refund but here's what I did -
1) I bought the eBay item. I knew it was a risk of spending another $20 bucks, but I thought it was important to try. Like someone said, it's $20 - is it worth the hassle.
2) After I received it, I filed for 'Not as Described or Parts Missing'. I got the response I shared here from Josh. Did we really expect that he'd jump in and say 'Oh wow, I can't believe I didn't ship it to you?!" ;)
3) I responded by saying let's just wait to see what eBay and PayPal have to say about it. I waited the days they wanted before getting involved (3 I think), and asked them to intervene.
4) eBay at first sent an email saying that I'd need to ship the item back. Later that day Josh issued a refund and the event was closed.
It sounds like at this point it is at your own risk. If you decide to try it, you could reference my complaint - case # 5100631475. Be sure to reference this page and any comments back and forth between you and Josh. And, as frustrating as all of this is, keep it professional. Calling him names or using foul language isn't going to get eBay to decide in your favor. I'm surprised ebay hasn't shut him down.
That thieving twat waffle canceled my eBay order due to "out of stock or other reason." Oh the other reason is that you know you're guilty of taking my money and never fulfilling your part of the agreement of Kickstarter?
A while ago someone posted Josh's address
3625 Palomar Lane
San Jose, CA 95127
I haven't gotten mine yet. But reading these comments it looks like I won't be getting it anytime soon. Should I be asking for a refund?!
I'm seriously debating on whether or not to buy this on ebay and get a refund. Anyone else recently try?
Guess I went the way of Lucas, Josh just cancelled my order =[
Just put in my eBay order. Wish me luck. Thanks to Olivia and all of you guys here for the info.
He rejected / cancelled my order a few times already. Your mileage will vary on this. I do agree with @Eric that we need to draw more attention. The "con artist" has a bigcartel going on too.
Thank you for the great updates, Olivia! Love the article on SFist, hadn't seen that before.
I encourage everyone to order the cards on ebay and then demand a refund. It was fairly painless, and important for us to draw attention to this con artist.
thank you for all the info @Olivia! i just bought it from ebay now hopefully i can get this and get the refund since i already paid for it. Seriously all of this just for an expansion pack. some people are just pure evil.
Update 02/28 10:40PM
Spoke to Paypal and ebay. Got an email from Paypal saying the refund is coming. Ebay said I didn't have to return anything. All in all, I got my refund for my ebay purchase. Got my item (minus the PDF) for my kickstart. You'd think this guy would even just distribute the PDF ...
IN OTHER NEWS: http://sfist.com/2016/02/24/bay_area_cards_against_humanity_fraud_kickstarter.php
This was posted on the 24th, 4 days before this post. Legally, these are our products. We funded them on our free will, yes. However, the project person(s) are are obligated to give the product (or whatever was funded) in return. I understand Kickstarter's position, as they are just a third party that takes a % of the funds backed and have no stance on whether or not the project is fulfilled. There needs to be some kind of fix to this. As of right now, his name is on blast on a somewhat known website.
A friend of mine reached out to me today about the issue. I didn't know he was in the same hole as me. I suggested what he should do ... few minutes later Josh seem to reject the purchase, claiming that he no longer has the product. Either a) He legitimately doesn't have anymore "extras". b) He caught on to what's going on and running, again. c) He has a list of backers and is now rejecting orders that has the names d) Ebay shut him down. You can still file a claim against him at your local police station, claiming stolen property. I spoke with an officer and he didn't officially give me an answer. However, he did say that it's a tricky situation, as we all voluntarily gave him funds. If we want to pursue it, a lawyer may be needed.
Thank you again to everyone cracking down on this. Josh is a fraud. If I didn't say it, the article above said it. You all are wonderful people. Thank you for all your efforts in this.
@Will There is no official solution unfortunately. In the end, I got what I paid for, the cards. It took two weeks of back and forth with him, ebay, and paypal. Which by the way ... is HORRIBLE quality. My recommendation, at this point, is play it out and see what happens. Now that josh is rejecting orders, I don't know what else can be possibly be done. Other than going to court.
