@Leon Genking. How did you do on the Israel Policestation? Ariel Shtul is also friend with Efrat Barit (Facebook). She had together with Saar Shai the Kickstarter Ringbow project. that utterly failed as well. What the have in common is that they Tell Kickstarter and heir backer they live in the US. But they don't. The live(d) in Israel + that Saar Shai moved to London. (He backed out of the Ringbow project) to my opinion Kickstarter does little to nothing to verify who their creators realy are and where they are living. It is very easy to obtain an identity. Verified email-adress. For Ariel Shtul he still is active on facebook. Efrat Barit is not. (last FB activity 2012) Good luck for you all and I still want my money back.
He has backed other products on here can't the address that the items are being shipped to be obtain somehow to get a possible lead on this guy can get our money back
@Ariel Shtul. Don't bother to log in. Not on Sept. 9th and not in the future. As long if don't do not refund or deliver, you won't find new customers here. In fact most of the think that you are a liar and a thief!
Yes Leon, thank you! If we were to post a complaint on the Facebook site you supplied, since it's all written in Hebrew which I'm sure many backers are unable to read, perhaps you would supply some of the language in terms of what would be helpful to say in our complaint post.
Thank you,
Andrea
I'm a little late to the comments party. Interesting that his listed website is actually for a weight loss website. It's ironic as I lost a little weight in my bank balance from this project.
I started the process of filing charges against this Israeli scammer in Israel which I'm from in local police .
Great news!!!! Given that this disreputable dic (Ariel) continues to check in here regularly hopefully he is seeing it. Either way it looks like he is trying to rip more people off under another alias. At least that's what my friend tells me.
I have been following the comment section for a different project where there is a dispute and I have learned some information that is at least interesting if not useful for the backers here.
https://www.kickstarter.com/projects/cloud-guys/plug-the-brain-of-your-devices The similarity to this project is that the deliveries are behind schedule as they are here; but the differences are large. In that project there is still communication with the backers through updates and also a project website and blog, the deliveries are behind by months, and that project was funded for $1.2 million verses $8,600 here.
With that background out of the way here is what I learned.
- Amazon takes payments from your credit card (or your other source) and then distributes them. So if a refund request from the creator fails, and a refund from Amazon fails, you can still go to your credit card for a refund. You can get a refund even if the charge is old. And you need to make the refund (charge-back) from your card company to "Amazon," and make sure the card company representative you talk to understands the unique situation of Amazon being a 3rd party intermediary collecting funds and redistributing them.
The other thing is that there was a court case in Washington where they set a precedent by throwing out the premise that we are investing in a project and said we were purchasing a product. The consequences of this are huge. Kickstarter cases are now in criminal court instead of civil court and creators are subject to criminal penalties under the consumer protection laws.
http://atg.wa.gov/pressrelease.aspx… http://mynorthwest.com/11/2511738/First-ever-lawsuit-filed-over-failed-Kickstarter-campaign Now, it needs to be noted that this is in Washington and does not automatically become a binding precedent in other states; but there is now case law to argue the point. And if there are ever creator(s) that cross state lines it is possible federal court could have jurisdiction and make a national precedent.
Now with the information of the Washington case backers from there can definitely go to their Attorney General; and anyone from a different state could do the same and see if they can convince their State's Attorney to bring suit under their consumer protection laws.
One caveat is that creators who come to the U.S. to start a project and then remove themselves to another country may have effectively removed themselves from the reach of U.S. law. Although -imo- if the person is a U.S. citizen they would still be liable in some way; possibly in the tax system when they file their US taxes and if they ever stepped back in this country they would be subject to arrest (if a criminal case had been filed against them).
So I encourage all backers to file with their card company and to contact their State's Attorney consumer protection office.
AND PLEASE - All backers from Washington, contact the Attorney General and ask that 1) a case be filed against Ariel Shtul and 2) when he misses the court date because he is in Israel, ask to have an arrest warrant issued and distributed to all states and immigration. That way if he steps foot in the US again he will be arrested if not entry then when he is stopped when he so much as rolls through a stop sign.
Unfortunately Maxim, we got swindled. Ariel took off with our money, probably paid for his trip to Israel that he took shortly after the project was funded.
@Tobias - I'm sorry, I take that back. You need to be registered and signed in to see the posting. Didn't know about this site, I'm sure I speak for others when I say thank you for adding Ariel to that site!
I think that the prick keeps checking in to see if we have given up so he can introduce another campaign. He logged in again today. There's no way he feels any guilt for screwing us, he wants more.
Use this space to cheer the creator along, and talk to your fellow backers.
