I don't think there are many options concerning legal action. The only action you can take is to punch him in the face if you happen to run into him.
Anyone interested in pursuing legal action? Not sure what can be done, but I think its worth investigating.

This kickstarter is a bad joke - made four times the target and rode off into the sunset. Not impressed.
Bummer.. no.5 in a grand total of 175 projects backed. And in only 1 of those 5 i saw it coming in hinesight.
Dan Hall, I asked the same question about three weeks ago and got no response on here. Just to let you know, I have emailed AmazonPayments and they hide behind the "been too long to care policy." Kickstarter staff did actually email me back but they also did not care too much. Was just given a series of "We're sorry for your bad experience" lines from KickStarter.

Concerning this project, has anyone recieved a response from either Kickstarter or AmazonPayments?
As of August, the scum brothers seem to have snuck out of the condo they were squatting in and have never been heard from since. Who cares, I'm out $25 bucks....I've lost more than that in donated pants pockets.
Either way, lesson learned. This whole thing is over.
The only real tragedy (other than the poor woman who had to go through the AirBnB debocle) is that this game looked SOOO cool.
I still want to believe... But that Air bnb thing has really thrown me for a loop.

Pedro, super unlikely. As far as I know kickstarter is very strict with their "buyer beware" Policy. Refunds can only come from the person running the project.

I usually dont care too much about deadlines because i still have a lot of backlog to clean but i havent seen any update from this game since July.

Well, fairly certain now that I'll never see those ten bucks again or the commodity I paid for. I can only hope this project will brand Pashanin's future works in such a way that he won't be able to work in the industry, with all his credibility down the drain.
Would someone be able to post their communication with amazon that led to a refund? I would like to get a refund, as it is clearly that the creator is a scammer, and kickstarer won't take any responsibility in the issue besides the classic "talk to him" answer.
While I know its not kickstarters problem that Mark is a thief, they still should uphold their terms and agreements. Even if that means taking him to court representing the backers.

The demo was awesome, it really boosted my faith in the game at the time. They actually built an awesome game engine and had a great idea before they bitched out and betrayed 2,386 people.
One thing that still escapes me about this. There was a solid product available, as evidenced by the demo. Whenever I back things, the demo serves as proof of concept, I.E. not gonna get scammed, generally. So my question is, how on earth do you go through the effort to put together a demo that well and then not deliver on any of it?
i want my $35 back!
Please refund me my 10$ hollar. It would be better spent on literally anything else.

No, it's not time. Don't get me wrong, I'm as sick of this project and especially the man in charge an anyone, but they made the terms now, so I'm not sure you can apply it here. for the project that is long after funding. If you put yout project to kickstarter you have to agree to their terms. And here He didn't agree with these new terms so you can't really sue Him, because of these new terms. That is my opinion as a "civilian". Maybe someone with knowledge of law can back me up ;)
Kickstarter made the terms of service clearer. "If a creator is unable to complete their project and fulfill rewards, they've failed to live up to the basic obligations of this agreement. To right this, they must make every reasonable effort to find another way of bringing the project to the best possible conclusion for backers,"

Final update: After I bitched about Amazon's "advice", they responded by crediting my Amazon account $10 (the amount of my ConEx pledge) on my next purchase. So there's that.
Update: Amazon hilariously suggested I ask Mr. Pashanin for a refund. The chances of that at this point seem to be low.
Yeah I was told that the transactions were past the time period for filing a dispute. Here's what they said:

Unfortunately my bank said they only reimburse on products not received within a 120 day window :(
I am curious as to how those of you who have gotten Amazon Payments to refund you have done it. I had to resort to sending an e-mail to their support because the standard complaint form would not allow me to continue (too much time has passed since the transaction). We'll see if it works.
I got refunded but you have to make a stink. Tell them to change their policy while you're at it.
Lars, thanks for the tip. I'll definitely be contacting Amazon payments. Daniel, don't let it this whole thing sour you. I've backed other projects and got everything that I bought from the crew that made Run, Fight or Die for example.
