      At the time of this investigation, there were 170 backers and I could see them all in the list. However, in the 1 hour spent so far, this ridiculous campaign has picked up backer 171 who miraculously backed at $10K... Good thing, because we certainly have not had enough of those around here!!! ;-)

      105 legitimate backers, that I would speculate are completely legitimate... I.E. At least 22 of them backed OUYA!

      1 backer whom I am unsure of...

      And 64 that I would certainly question their legitimacy for the following reasons:
      6 of the backers backed a film called Follow Friday the Film (5 it was their only other backed project on KS), which appears to be a film that was to be released in December of 2012 and has not seen the light of day. Last comment on the project was a backer asking for updates. Pretty amazing coincidence that 6 of those backers ended up here!!!

      47 who created accounts in August that have only backed this project and no others. The only press I can find on the internet about this project in August is towards the end where all of the scam suspicions started popping up.

      12 who created accounts in September, well after this project was exposed as fraudulent...

      Of all of these suspicious accounts, 5 have commented here and have all been supportive.

      Of these 64 accounts, there are 2 Enlai Chu accounts, 2 Justin Won accounts (3 Won accounts overall), 3 accounts with the last name of Margolis, 2 with the last name of Prat, and an account Wence, Wence Swets, Francien Swets and a d.j.w.swets!

      Wow! Statistically speaking, what are the odds that a project with 170 backers would have 2 Enlai Chu's, 2 Juston Won's, 3 Margolis's, 2 Prats, 2 Wence's and 3 Swets's? These people should really be playing Powerball and not developing shitty games for a failing console!!!

      The other amazing thing about this project is the number of philanthropic backers! A full 61.15% of the backers money here is directed to no reward! Pretty impressive, huh?

      Another amazing fact is that there are 10x10k backers here and only 4 want to go to the Super Bowl Party!

      The part that amazes me most the though, is that none of the backers have even asked a question about the reward description!

      "[The Big Game] Join our team in New York City on February 1, 2014 for a VIP Super Bowl Party that is not to be missed!"

      My questions would be:
      Is airfare included?
      Is the game included?
      Is lodging included?

      I would think someone throwing down 10k would want to know these things!

      Another cool thing about this project is that $120k out of the $125k has been funded in only 9 of the 30 days to date... The other 21 days have only produced only $5k. Must have been some great, positive press on the days proceeding those 9 days!!!

      But, enough glowing statements about how wonderful this projects is...

      I have a couple of concerns...

      If my name was Julie and I launched OUYA, I wonder why these guys are running a Kickstarter project to fund a game that will be released on September 15th... I also might wonder why this Kickstarter project has more 10k backers than any project in the history of Kickstarter... I also might wonder why I will be paying these guys roughly 100k on the 15th of September for a game that is already complete!

      If I was Kickstarter, I would wonder why I have suspended the Holmes OUYA project and let this one continue, when the evidence here is way more overwhelming here than it was on the Holmes project... Of course, maybe I like my 5% here much better than I did on Holmes...

      They should get licence an endorsement deal with Kobe Red Jerky. "Kobe Red - the OFFICIAL snack of Gridiron Thunder!"

      Seriously though, the NFL is not taking new video games. EA already has that licence (http://kotaku.com/5988357/remember-its-not-just-the-nfls-exclusive-license-with-madden-the-players-union-has-one-too) a company MORE litigious than the NFL, which on it's own merch submission page says:

      " How It Works. NFLP serves as the representative of the National Football League and its member professional football clubs for the licensing of their trademarks and logos (the “NFL Marks”).The NFL Marks include, among others, the NFL shield, the words SUPER BOWL and PRO BOWL, the Super Bowl and Pro Bowl logos, and the team names, nicknames, colors, symbols, emblems, helmet designs and uniform designs."

      So there goes your fantasy football player names, pictures, team logos, use of the NFL shield etc (even in fantasy football and news pages.) Also, on that same page (https://www.nfl.info/NFLConsProd/Welcome/CpPrequalify.htm) it lists things that the NFL is currently NOT interested in and "Video Games" is on that list. Also, it's a prequalification - so if he's getting those licences for the 15th he should have them now.

      If they are actually planning on delivering a game on the 15th with FULL fantasy football features, ONLINE play, CUSTOMIZABLE TEAMS, a working, legal stream of news, and most importantly the ability to play as the exact, RL players from your fantasy football team, they should have those licences by now. And there is some legal language that says they have to deliver what they solicited money for if they can do so in good faith.

      "Is a creator legally obligated to fulfill the promises of their project?
      Yes. Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. (This is what creators see before they launch.) We crafted these terms to create a legal requirement for creators to follow through on their projects, and to give backers a recourse if they don't. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill."

      So if they do make shovelware without the features, they might want to hold onto that money since they basically made themselves legally accountable to deliver a product IF possible (and it's hard to argue it's not possible if you're holding 300K - releasing half a game on the 15th, then updating it for 3 weeks, then never producing the required features <> delivering on a promise agreed to.)

      So again, if the game is what they say it is, I will apologize up and down and be an EAGER player. The reason I care/am so mad is that I LOVE Blitz and I want this to be real. But none of the facts show they can deliver this, and they've straight up stopped replying to questions for days. Basically, they're waiting it out, knowing nothing they say can help, but many things they say can hurt. It's pretty telling.

      I really wanted this game, and I still do - but there seems to be no way in hell they can actually produce it and I am very skeptical of how long they'll support it post release/if the features will be there that were promised/that they actually CAN produce the game they're claiming they can.

      If you're REALLY releasing in a week, a 10 minute gameplay video would go a LONG way to easing our minds, and if you can't produce 10 minutes of gameplay, you won't have a game on the 15th. Period.

      That's the last I'll comment on it, cause I've taken more than my dollar's worth of comment space, but there you go. *kicks back in a lawn chair, takes popcorn and beer out, watches the last day unfold.*

      Will this 10k Superbowl kick off party be shown live on webcam?

      I'm assuming it's going to be LAVISH at 10K a head, filled with celebrities, an open bar, expensive and delightful food treats, and lots and lots of live playing of the new Ouya hit GRIDIRON THUNDER!!!!

      Think about it! You could prove to all the haters that this is a real, fun, playable game and you have numerous NFL contacts. With a live stream we could all get in on the fun of this I'm certain gala event and get to meet the benefactors that, as football fan says "the larger backers are making the game possible for all players - small backers and non-backers included."

      And he's right... they really are delivering the game to us, and we should thank them. Live. On camera. While people play the full, working game in the background. At the party you're totally really going to throw... for 10k a head.

      Thoughts?

      (And I paid a dollar, a dollar should get me in to the webcam of the feed to the party that will totally happen and is not just a perk nobody can check up on later!)

      That's the allegation - If you look at Neverending Nightmares' chart, you get some sales every day in differing amount, and it looks like this - http://www.kicktraq.com/projects/infinitap/neverending-nightmares/#chart-daily with 1000+ backers, you get a tidy sum of over 29K (which sin't bad.)

      Compare that with the chart Riggo shared below. There are huge infusions of cash in very round amounts (25K one day, 10K another, and 0ish most days) and may people donating huge amounts of cash but taking no perks at all (and why would you - you're basically giving yourself work.)

      There's not much reporting about it (http://www.crowdfundinsider.com/2013/09/21919-drama-continues-on-successfully-funded-ouya-game-gridiron-thunder/) but basically it looks like someone is building some shovelware to raid 114k-214k and counting money from the Free the Games fund. And the weirdest thing is Ouya doesn't seem to care that much.

      Also, expect to see this go higher - it can go as high as 250K, and note how many "Party invitations" they're selling - they're set up for a sudden rush of high $ donors.

      They'll probably have the party, too, cause hell, they're not paying. The thing that makes me mad is I WANTED this game. It looked like it might be a cool, Blitz like thing for the Ouya, which I also like and is struggling. But it's not - it's looking like it's crapware/an investment strategy.

      That's not good for backers. That's not good for Ouya. That's not good for Kickstarter. It's why I spent a dollar just to be able to finally comment on this nonsense Goat, you're a research GOD, and people have been paying attention.

      I'm starting to suspect this is going to be another "the War Z" or Big Rigs type game (A game that exists only to fulfil someone's contractual obligation. http://www.youtube.com/watch…)

      Hmmm, interesting. I didn't see this rule. Though this doesn't seem as strong as Kickstarter's escape clauses. But then again, I'm not a lawyer ...

      There is also the issue that Ouya publicly supported MogoTXT, so they'd have to deal with the PR repercussions of breaking the deal.

      They can shut the whole thing down, per the contract you sign when you enter:

      "9. RIGHT TO CANCEL OR SUSPEND CONTEST If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of OUYA that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, OUYA reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest."

      So they have a pretty wide ability to shut it down, but once they've finished the "contest" it'll be harder.

      @William L Ross. I think Kickstarter indeed has such a button, since their Terms of Use give them the ability to terminate without cause. But I don't think Ouya actually has a button too. MogoTXT is within the rules of the Free the Games Fund, and would most likely sue Ouya if they tried to pull it.

      They'll get away with it. In less than two days, you'll need lawyers to stop it - it's what they and Elementary are counting on. Once the Kickstarter ends, all sorts of things lock in. Right now anyone from Ouya to Kickstarter could stop this with a push of a button, but in 42 hours it'll cost more than the money "freed" to get any of it back/not pay it.

      Hold the phone going to release in a few weeks and getting funding when people have already finished the project practally? That doesn't make any since and defeats the purpose of doing a kickstarter. Which is to fund a project you are trying to work on and are unable to fund to complete yourself. You clearly are not having that problem if it will be done in a few weeks.You are just taking advantage of the Free The games event and ouya teams offer at that point to gain even more money than you would have for sales. Its sad because other games in the event are hardly receiving any attention and they are no where near complete.

      Where are you getting that from? No I simply speak about the hard facts and data here: the number of backers.

      For example Neverending Nightmares; 1.100 people so far wants to see this game done, and yet it's still far from the $50K goal (25%). So the goal set by OUYA means that they consider a game should get the pledges doubled when it gets more than 4.000 potential buyers (and that's still low, and most buyers won't even buy it on OUYA).

      With it's 150 potential buyers 3 days from KS end, Gridiron isn't a very good investment for OUYA. It's just logical.

      Selling an idea like Gridiron to a business partner like OUYA is much easier (you just need a bit of marketing spin; online play! NFL! fun!) than selling an actual game to gamers.

      It seems like Julie and Mr Won don't know what is really needed to get a great number of gamers excited and eager to buy a game.


      What was needed was to wait a bit more to make a more polished KS campaign with much more to show, then you bet people would be excited. It's like MogoTXT did not care about the campaign, but only about getting a KS done and releasing a game ASAP. Why? They truly missed an opportunity to make a great campaign by waiting a bit longer to have more to show before asking for pledges.

      Could it be because MogoTXT doesn't care about the pledges since the game is already funded?

      At this point, pretty much everyone agrees on this:
      - No one is backing this project but friends of Andrew (With their own money? Who can prove it? And who can prove they aren't investing in the game?).
      - The ROI is extremely interesting, 70% in two weeks, and up to 95% secured (potentially more depending on the sales and additional $100K). It's pretty clear Andrew is more of a business man than someone with gamers in mind. The game will be done, it will be ignored, and MogoTXT will reap the money. Not even Chucklenauts, the game devs, no these are subcontracted. MogoTXT, the producer, will get all the money regardless of the quality of the game, so they have 0 incentive in spending too much money in it since it has been made clear their is 0 interest in that title from the public.
      - All previews that have been posted so far look really bad, show no AI behavior, and could be nothing more than machinima.That player dancing macarena? Come on. Is that all you can show us? The game should be out in few weeks.
      - Andrew has been extremely non-committal in his answers, knowing very much the future for this game looks very bleak and that it's better not to promise too much so they can stop spending money on it beyond the bare minimum.

      But unfortunately, all of this is legal, and is mainly because OUYA are not being very smart in the way they use their fund and support this game (but they HAVE to, they have nothing else so far), and KS and Amazon closing their eyes as long as they get their cut.

      Is it legal? Yes
      Is it moral or ethical? No
      Is it extremely cynical? Yes

      The only comfort I find in this situation is that at least the Chucklenauts guys will get some crumbs from that money to feed their families for a few months.

      As for Andrew, I wouldn't want to be in his shoes when you read all the bad press about the campaign on the net and him pretty much saying nothing else than "it's not illegal". But some people seem to be able to switch off their conscience at will and he must be one of them.

      There isn’t a large community in the rich little Valley and word spreads fast if you are in the right social network. Kickstarter’s are HIGHLY suspicious of this campaign because of the backer to pledge size ratio. The recent VC capital infusion from a very reputable VC creating the FTGF likely was known by VC insiders. Guess Who is on the inside of major VC’s? This company beforehand was comprised primarily of two young college graduates (who really have limited Game development XP) and a lawyer that has been in the Valley that has likely built up the right connections. Any fool would choose to have free development and a fast ROI on an Ouya/X-Platform title by participating in the FTGF if the social network was easily attainable. Obviously Drew found a quick way to get a game made for free (likely injecting his friends and family capital and his own). CLEARLY MogoTXT wasn’t the best OUYA game developer on kickstarter (you can look at their one iOS product), but simply because there was likely inside knowledge, seed money. The original team had never developed on an OUYA. OUYA Devs are a super small community at this point in time. MogoTXT managed to find a Skilled Team JUST in time to film the KS and have something to show for FTGF. Anything is possible when you do have seed cash and the right social Network.
      Money is Gravity, it is easier to get more if you have more.
      The retraction of a defamation/false light statement is allowed in some states. This message is a retraction of the previous statements made on this Kickstarter account.
      For the people that have their convictions regarding who is posting to this account the optimal benefit for all parties is almost always a Nash Equilibrium, Machiavellian tactics are so destructive. Finding the Lagrangian point reaps the best rewards in regards to gravity.
