      I am glad I only put forth a small amount but if I were the ones who were much higher I would be so pissed. Would definitely track this person down and get my money out of him one way or another. As a note, it's not hard to track people especially when they link their real facebook to these.

      I still think it's problematic with projects like this that turn into solo ventures, as us backers have no way of knowing if something dramatic has happened to the creator.. Who'd update us in the event of misfortune that left the creator unable to do so him/herself?
      Kinda hard to say which option is worse, that we got scammed of funds that could have gone to other, legitimate projects, or that the creator was indeed sincere but met an untimely end or similar ill fortune.. :/

      I've also opened a ticket and learned at least one new thing. There is a moderation team and at least my ticket has been forwarded to this team, maybe you're as well. Also it seems that kickstarter has a "blacklist" of sorts that might prevent or limit any future project Kyle would start. Though with a prior project created and left unfulfilled it'd be unlikely he'd start or even get much backers due to this project.

      Here's the text of the response to me:
      Hi Eric,

      Thanks for reaching out and sorry to hear about this.

      When projects launch on Kickstarter they’re often in the early stages of development. Before the backer rewards can be fulfilled, the project itself must first be completed. It’s not uncommon for things to take longer than planned, and creators are expected to keep backers in the loop along the way.

      That said, I took a look and see that it has been a while since the creator posted an update. We reached out to him and asked him to post an update and reply to his backers' messages. While we certainly encourage creators like this to stay in touch, unfortunately we have no way of forcing them to do so.

      I've also passed this project along to our moderation team for review. We've made a note and the status of this project would be taken into consideration should the project creator submit another project.

      So, fellow backers, I am still pursuing this, but it is beginning to look like we'd have to sue Kyle to recoup our losses, without any intervention from Kickstarter. It seems the Terms of Use specify that Kickstarter is not part of the agreement it brokers, and so Kickstarter is legally obligated to do jack squat when it facilitates fraud.

      As I said, I'm still looking into this. And suing Kyle for a measly $8,000, if for no other reason than justice (and sheer spite, of course), is not off the table.

      More on this topic once Kickstarter Support starts responding to me again.

      Well, you can navigate through http://www.kickstarter.com/contact until they give you the option to open a support ticket, then describe the problem. Kickstarter's Terms of Use require project creators to either fulfill pledge rewards or refund everything. Contact with backers is highly important.

      I contacted Kickstarter myself, and this was the response:

      Thanks for writing in and bringing our attention to this project. I'm very sorry to hear that you and the other backers of this project have gone for so long without receiving an update on this project. We take communication between project creators and backers very seriously (it's a must). That being said, we have definitely made a note of this behavior.

      We have sent the creator of this project a message, just reminding them of our Terms of Use and their obligation to fulfill their rewards (as initially promised) or to refund all backers. We've also reminded them that we encourage open communication throughout all stages of a project. We hope that this reminder will encourage them to engage with their backer community a bit more actively.

      Thank you again for being a thoughtful backer and writing in to let us know about this. I hope that the creator does provide you and the rest of their backer community with an update on this project soon.

      Well, today has marked the first day of the estimated delivery month. In two days it will be an entire year without any official communication on the project, longer for any post or update on it. There's also been no evidence of the "kicking it forward" donation to another campaign. I am not hopeful to see anything materialize from this project and in at most 30 days I will likely be pursuing a refund but like some others I'm only out $20. Likely I'll try with kickstarter and then maybe see if there's any recourse through a local group in Blackville, SC. I think we have a good case for this to be categorized as fraud rather than just a failed project.

      He entered into a legally binding contract to either fulfill our rewards or refund them. I'm not sure how to go about getting my money back but he agreed to do one or the other when he started this thing.

      Is a creator legally obligated to fulfill the promises of their project?

      Yes. Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. We crafted these terms to create a legal requirement for creators to follow through on their projects, and to give backers a recourse if they don't. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.

      Luckily I'm only out 25.00 and while it's not much it's the principle behind it. All I know is that if he doesn't deliver and continues with no contact he will be in violation of that agreement.

      I sent him a PM on Facebook on January 29th about the game's progress, whether or not we (the backers) will receive a refund if he can show nothing by the delivery date, etc. I still have yet to get a response from him. If enough of us ask him, surely he'll have to send out some response, right?

      If not, come June, we all contact Kickstarter about the blatant cash grab that apparently still leaves him feeling "frickin' bored".

      I knew I should have listened to my gut and not backed this game. Why is the minimum pledge to get the game $15, when the game is supposed to only cost $5, when it's supposedly released. Or you can supposedly play it for free on some shifty website. My gut told me something felt wrong about that.

      But the artwork and music won me over. Oh well, at least I only lost $15. I can't begin to image how angry and hurt the people who pledged higher amounts must feel. I still continue to back other video game projects. I still believe in Kickstarter. But I've been a lot more careful with what I back now.

      As has been mentioned by a number of people already, it would be great to have some kind of update as to the project's progress. Even if it's just to tell everyone that you've given up and scrapped the project, never to touch it again, any update would be good for the backers. It is going on five months of silence, which is far too long for anyone that has invested in your work.

      This is not looking good at all. I scanned Kyle Pruitt's public facebook for any mentions about this project but couldn't find any. Maybe he posts only for friends but I highly doubt it. In his public info he writes about becoming a sailor and maybe he has different life goals by now. It seems to be an abandoned project. The only person that can shed any light on this is not answering the comments/messages. If this turns out to be a scam, then from now on I will only pledge on projects coming from people with a current respectable track of games/products on their names. Experiences like this ruin it for the first timers with good intentions. Kyle, you still have chances to redeem yourself and provide us with an update, any update will do.

      His last login was August 16th, so he should have at least seen any private messages that got sent. Perhaps it would be worthwhile to contact him via facebook (perhaps through one of his friends if he doesn't allow messages directly); if he's just a huge procrastinator like myself, then getting asked in person by someone he knows would be the fastest way to get a response.

      I sent Kyle a private message about 3 weeks ago asking for ANY kind of update, whether there's good news or bad news...and I haven't received even an acknowledgment of my message, let alone a response. And, of course, the official website hasn't been updated since April.

      I'm a little nervous that the project has just dropped off the face of the Earth.

      Hey, how is the game coming along? It's been three weeks since the last comment/update from the Erythia Team, so I'd love to hear what you all have been up to! Did you manage to find an animation studio?

      If something has gone wrong, and if that something happens to be related to the music, there is at least one backer who could try to help! :) Regardless of whether things are going well or not, I think we backers would love to hear something - anything at all, really.

      I'm really looking forward to the game!

      Alright! We've reached the end! In total, we were able to not only reach out set goal of $5,000, but also exceed it by almost $3,000. Talk about exciting! For those curious, the extra funding will be going towards providing assets to the game they we originally did not think we would be able to. Namely, animated cutscenes and extra artwork!

      According to Kickstarter, it will be another 14 days before the funding is cleared, but we're already hard at work finding an animation studio that fits Erythia's style. Stay tuned in the coming weeks for more updates!

I'm surprised that nothing has been mentioned in terms of new news, updates, or even a congrats on continuing to crush the pledge (currently by 50%) but... nothing???
