      i also tried to get a refund without luck. Strangely Amazon told me i had to wait until June before this was over due (i think they confused this with Up Front). I would like this to get made but from what i have read on Boardgamegeek (Up Front page) i really don't see it happening.
      This was my first kickstarter and i was pretty certain it would be my last. Damn 'Heroes of Normandie' changed my mind.

      @Brady Sadler, I have tried to get a refund, sending emails, posting complaints, etc... I never got one. I just quit worrying about it. It still pisses me off to no end! It seems like a lot of companies and entrepreneurs turn a deaf ear after they get OUR money. So I will take my lumps from this as a lesson learned. My newest and best form of protest: I WILL NEVER BACK A KICKSTARTER PROJECT AGAIN!

      I am proud to say I have been Kickstarter free since March 21st, 2013 and holding strong!

      It only makes sense that the plan is for everyone to have their copies of AiyP by October-November (emphasis on "plan").

      There are KS backers that are complaining that a tabletop project is a month behind schedule? I think those folks might need to look at the TON of other projects that didn't hit their deadlines by way more than one month (I've backed over 80 projects, believe me, it's common).

      This is not a retail website. It is a crowd-sourcing site for new projects, companies and other endeavors. New things sometimes don't go as quickly as expected. It's the same in any industry.

      I wish Kickstarter project creators would offer REALISTIC timelines for the production and distribution of their projects. It's a bit like builders who tell you a job will take 6 weeks and 3 months later they're still banging around. I have backed a few things and, as yet, not one has been delivered on time. I don't expect people delivering their first project or trying to establish a small business to be 'ruthlessly efficient' but by the same token getting projects delivered at least close to the promised date would be nice. My advice would be: work out how long you think it will take to deliver your project then double that length of time...if it gets done earlier everyone is happy, if not, you end up where we are now with people demanding refunds and bailing out on the project. On the flip side, I don't think pulling out of a project which is still a going concern is particularly helpful either. Perhaps it would be a prudent move, public relations-wise, to offer some sort of 'sorry this has taken so long' bonus. It needn't be anything over-the-top just a token rewarding backers' patience.

      I am in this until the end, but I'd really like to emphasize that regular updates showing the progress on the different elements of the game is very reassuring to see. If the game is delayed then it will match the 95% of other game projects I've backed having been delayed to varying lengths, so I have no issue there in waiting that bit longer for a quality product. Thanks for the recent updates and please keep them coming!

      It is because of this project and a few others (this one by far being the worst!), that I am not and will not be backing another project on Kickstarter! I would rather wait for a project to hit the store shelves than ever have to put up with crap like this again.

      After asking for a refund and getting no response from Rik, and since Amazon payments 105 day deadline since taking the payment has passed for them to refund my money, I had no choice but to contact my credit card company. Since the due date has passed and the creator of the project is not even answering any requests, they credited my account for my full pledge amount. I assume they will go after the money from Rik themselves. If you used a credit card to pay for this and are not getting anywhere with your request for a refund, I suggest you do the same and you are likely to see your money. My guess is if that enough people do this, the credit card companies and Amazon payments and Kickstarter will have no choice but to enact new rules about how refunds get processed after a project fails to meet its deadline.

      I will endeavour to be respectful and considerate. I am a UK pledger after all!!
      So, when am I really going to get what I pledged my $105 (plus $30 for shipping) for back in September? The guy who took my money suggested March 2013 as a delivery date. It is now April 2013 and no sign of any goods.
      Me thinks I have placed too much trust in this US of A "Kickstarter" thingy and I may see my goods some time soon, or maybe not at all. I placed a similar pledge, (more fool me, and even more $'s in fact, for Up Front), which seems to be going even more "breasts-up", as we kind of say here in the dear old naive "Blighty".
      I have read a few of the comments on this trail (before I got bored) about why poor old developer chappie cannot meet his commitments. Suffice to say, what a crock. Why should I be interested in excuses? That's a rhetorical question btw. I am not. The developer chappie has had over $100K for over 6 months, 3 times more than he asked for, and still cannot deliver.
      Twice bitten, but never again. I may get my goods in the end, but these have not been delivered with the same enthusiasm you guys took my (our) money.

      @ Dwayne - As mentioned, we had no updates for Airborne and we apologized for not at least saying something - we were in the wrong. As for which we are focussed on, it is now BOTH. It just means some longer nights and some discussions with the printer for tandem operations.
      However, if you do not see this as a reasonable answer we will be more than willing to refund you your pledge.

      There was an update 5 days ago, the art is still being done. It does not appear the project has been abandoned by any means. If you want to be disappointed about the delay that's understandable. What I dont get is what do you expect from a legality perspective? If your involved with open legislation it would be foolish to respond to comments on message boards concerning the finer details. One poor judgement in posting something stupid could cost you the case.

      @LJ it is a rude comment but such a foolish concept as a refund on kickstarter deserved something beyond silently ignoring.

      I asked for a refund last Tuesday, haven't heard anything. I'm pretty much writing it off, so getting either my $ back or the game I paid for will be a pleasant surprise. Not that losing 70$ doesn't hurt, but it's not like I can do much about it.
      I've backed 15 things, mostly games, and while I might not have enjoyed all the games I've gotten as much as I thought I would, apart from 3 that recently closed, I've gotten everything I expected in a reasonable amount of time.
      There's definitely something to be learned from the way KS has evolved; large companies using it; projects as preorders; the use of stretch goals; etc. I'm not sure where I stand on a lot of it but until now I was reasonably satisfied and sometimes very pleased with KS. Granted, what allegedly happened here is (hopefully) very much an outlier.

      As a backer of 47 projects, all board games, I can safely say that kickstarter is a sucker's bet, with project organizers who are mostly incompetent people who care a lot, and communicate a lot...until the project is funded. Then, they are like Keyser Soze, you will never hear from them again...I have funded my last project, this is a failed system.

      Half the problem is that Rik hasn't let us know enough since this project funded, so I have to disagree with the idea that he'll let us know and that his backers are a priority. There's just no evidence of that.

      Additionally, Rik has stated here that he'll offer the refund.
      I have no problem asking for it.

      I'm sure when Rik knows what is happening he will let us know and I'm sure his first concern (after family and his business) is his backers.

      Just chill and wait for an answer.

      And as I was told when I was a young lad, "Never gamble with money you can't afford to lose ..."

      Kickstarter is never 100% (and I've backed 20+ projects with over $2,500 since October last year).

      You won't be able to get a refund as the money is most likely now frozen in the legal process and I doubt Rik will have the money out of his own pocket.

      If the company you worked for had legal problems, could you afford to bail them out with your own money ???

      I couldn't ...

      Just wait everyone and remember Rik is a person and is probably more upset with what is happening than you are.

      Thanks for the summary, Peter, that really helps me understand what is going on and where I stand in all of this. The issue of what the details are with the lawsuits between Phillip and Valley Games is not my concern as who knows what the true details of these cases are. My concern as a backer is that I hope I get the product I backed and paid for and hope Rik is able to fulflill our orders and deliver the products. Hopefully he wants to see these great games and labors of love become a reality just as we all do. Hopefully these legal issues can be settled quicky and to the best possible outcome to all parties involved, and that includes us as well.

      @Peter - well, being registered as a Texas company means they can be sued in Texas, but in terms of collecting on a money judgment, I think you have to do that where the assets are located (which may, or may not, be Texas) - I'm sure that explains why (at least in part) there were prior suits in California and Pennsylvania.

      @David Villa: Here's my summary of the legal problems.

      DISCLAIMER: I am not a lawyer, I have no background knowledge of the case, this is purely a summary of the legal documents and other details I've been able to find in my approximately two hours' investigation, plus some amateur interpretation.

      Valley Games took out two loans from Philip Sauer. They defaulted on these loans. Philip sued them through two different jurisdictions (Pennsylvania and California), Valley Games did not contest either judgement and damages were awarded against them. They have failed to pay either judgement.

      The president and vice-president of Valley Games set up a new company (Radiant Gaming). This new company is selling games developed by Valley Games and advertises itself as being the same company as Valley Games but under a different name.

      Philip Bauer has filed for legal action in the state of Texas (where Radiant Gaming is registered) seeking the previously-awarded damages and an injunction to stop Radiant Gaming disposing of assets which should be considered to belong to Valley Games. His allegation is that those assets are being fraudulently transferred from one company to the other without proper compensation in order to avoid paying him the money he is owed. The injunction has been granted, defendants have been notified and they have (I gather) until late March to respond to the case.

      The possible outcomes I can see (repeating: I am not a lawyer but also I am not an accountant so I have no idea which of these outcomes is more likely) are:
      1. The defendants could win the case, they could settle, they could lose but still be able to pay the debts and continue to do business. This outcome would have no impact on the backers.
      2. The defendants are unable to pay the debts, sell the company and the new owners would be obligated to fulfil backers' orders.
      3. The defendants ignore the judgements passed on them and continue to trade as they have been. This may result in the company collapsing before backers get their rewards.
      4. Radiant Gaming goes into liquidation. Backers are considered debtors and we would in that case probably receive partial refund.
      5. Radiant Gaming goes into liquidation. Backers are not considered debtors of the company but, because he put his own name on the project instead of the company name, are debtors of Rik Falch. Depending on whether he declares bankruptcy we may get either partial or full refunds, but we may need a class action suit to get that.
